BRUSH & PUJOL - WHAT WE DO

Our clients frequently ask what types of cases we handle. The following is a list which generally summarizes what we handle, although not exhaustive:

1. Personal Injury/Wrongful Death - We handle all types of personal injury, whether an automobile accident, medical malpractice, slip and fall, product liability, or any other way in which a person can be hurt and killed by the negligence of another person, firm or corporation. We have, together, defended insurance companies for over 30 years. We believe that this gives us an insight into how these companies function, work and analyze claims.

2. Divorce/Family Law - We handle divorce cases and post-divorce cases, modifications, alimony, child support and all other related matters regarding family law.

3. Domestic Violence/Injunctions - Injunctions are orders requiring a person to do or not do something. A common type of injunction granted today is an Injunction Against Domestic Violence. This typically occurs where one family member has been physically abused, stalked or is in fear for his or her safety from a spouse or other family member. The court may impose a variety of remedies when granting an injunction including ordering that the aggressor not come within so many feet of the person seeking the injunction. Violation of the court’s order may land the violator in jail. Injunctions can also affect child custody. If you feel your safety or physical well being, or that of a family member, is threatened please seek immediate assistance by contacting the police, court clerk and an attorney to determine your rights.

4. Discrimination/EEOC/Florida Commission on Human Relations - We handle both Plaintiffs and defense discrimination claims whether based upon race, sex, religion or national origins, either under the EEOC and/or under the Florida Human Relations statute and/or under the Americans with Disabilities Act (ADA).

5. Insurance Disputes/Coverage Issues - Often a personal injury or wrongful death claim will involve dealing with once or more insurance companies. We handle all types of insurance disputes including failure to pay PIP benefits, health insurance, property damage, disability benefits or any other way in which an insurer would deny or dispute benefits owed to an insured under an automobile policy, homeowner’s policy, disability policy, health insurance policy or any other type of insurance policy that is written in the State of Florida. Again, we have work collectively for insurance companies for over 30 years and are aware of various positions and attitudes that they have taken on various coverage issues.

6. Wage Claims - We handle claims involving failure to pay wages, bonuses or commissions. Normally even if this is a small amount, if proven, the Plaintiff is entitled to recover attorneys’ fees.

7. General Civil Litigation - We handle most types of general civil litigation which could involve trial in front of a jury or in front of a Judge. This would include breach of contract claims, damage claims, non-competition agreements, injunctions, arbitrations and all other types civil litigation generally.
